DiBiaggio Law Achieves 6-Figure Settlement in Wrongful Death Malpractice Case

MIAMI-DADE County, Florida—DiBiaggio Law announces a groundbreaking settlement in a medical malpractice wrongful death lawsuit. The six-figure agreement addresses allegations of gross negligence during anesthesia administration, which tragically led to a patient’s death.

The unexpected tragedy took place on March 16, 2023, when a young man went into the hospital for a routine medical procedure, an internal fixation ankle surgery, but did not survive, as he was allegedly given too much anesthesia.

DiBiaggio Law felt lucky to make a recovery because the young man was unmarried and had no children. The law firm had to prove that his mother, who lived with him, was financially dependent upon him.

During the procedure,the patient experienced prolonged hypotension under general anesthesia which went unaddressed, allegedly causing a hypoxic/ischemic brain injury. Despite extensive efforts to stabilize the patient’s condition, he was pronounced brain dead on April 2, 2023.

Allegations of Medical Negligence

The lawsuit, filed on behalf of the victim’s estate, cites multiple counts of negligence against individual practitioners, an anesthesia group, and the hospital. Significant allegations include inadequate monitoring and response to the patient’s critical condition, failure to administer proper medication, and negligent adjustments to the anesthesia plan during the high-risk procedure. The complaint also highlighted the lack of timely intervention and the equipment to halt the procedure when the patient’s health deteriorated.

A 6-Figure Settlement

The substantial settlement underscores the urgency of adhering to rigorous medical care standards, particularly during surgical procedures. It provides financial support and a measure of closure to the grieving family and sends a powerful message to healthcare providers about the severe consequences of deviating from standard practices.
